Former FBI Staff Member Alleges Wrongful Dismissal Due to Pride Banner Exhibition

A veteran FBI operative has initiated a legal case stating his dismissed because of exhibiting a rainbow symbol at his workstation.

As per the former employee, who worked in the agency for 16 years, the dismissal recently was “unconstitutional and politically motivated”.

Court Proceedings Asserts Free Speech Infringements

The legal filing contends that the bureau infringed upon the plaintiff’s First Amendment freedoms and took disciplinary steps against him because of expressing constitutionally covered communication.

The former specialist is seeking a court order to return his position at the bureau.

The comprehensive complaint, filed in a Washington court for the District of Columbia, states that Maltinsky was fired from his training in October over earlier exhibiting the flag at his workstation.

As stated in the document, the LGBTQ+ banner was presented to the plaintiff to acknowledge his contributions to promote the agency’s equality efforts.

Early on, my goal has been to serve the United States and ensure the nation’s safety beside the brilliant and dedicated personnel at the agency,” remarked Maltinsky.

He continued, I showed that symbol – which in 2021 was displayed at a federal building – not for political reasons, but as a symbol of acceptance, solidarity and impartial service.

These ideals that helped build the FBI strong. Now it is a place where people like me are targeted. I think I was dismissed not due to my identity, but rather because of what I represent: a proud gay man,” he concluded.

Sudden Dismissal Prior to Completion

Recently, the employee was accepted into the federal agent training academy at Quantico, Virginia, before what he called “abrupt dismissal shortly before finishing”.

The lawsuit also claims that later subsequent to the presidential inauguration, an colleague expressed an issue to the overseeing official about the presence of the Pride flag.

To be safe, Maltinsky requested that the legal advisor at the L.A. office review if the exhibition of the Progress Pride flag was permissible,” the document said.

The document continued, The legal officer told the employee that the display of the symbol did not violate any bureau guidelines.”

Informing of Dismissal

Despite this, on the first of October, the plaintiff received notice of his firing.

In a document referenced in the lawsuit, agency head Kash Patel wrote, I have concluded that you demonstrated poor judgment with an inappropriate display of a partisan emblem in your work area in your prior role at the L.A. bureau.

“Pursuant to Article II of the United States Constitution, and statutes of the U.S., your position with the Federal Bureau of Investigation is concluded.”

Attorney Remarks

In comments provided recently, his legal representative Kerrie Riggs said, The current leadership’s unlawfully firing him is a component of a larger campaign to purge federal agencies of staff with different viewpoints, or are from underrepresented communities, or who dare speak out against bias.

His case is not just about him, but involves protecting the rights and freedoms of all federal employees.”

Agency Reaction

The agency declined to comment regarding the case.

The case comes after another one submitted earlier by previous senior FBI officials that claimed they had been wrongfully terminated.

They alleged that Patel stated he had been ordered by the administration to dismiss any agent participating in an investigation into Trump.

Meanwhile, the bureau fired a nearly three-decade veteran earlier this month after the director was said to be angered by reports that the agency head had taken an official aircraft to go to a wrestling event during which his partner rendered the national anthem.

The official, an FBI employee for many years, was fired from leading the agency’s response team, which manages major security threats and the agency’s jet fleet.
